IFT fined 53,838 pesos Televisa

The Federal Telecommunications Institute (IFT) decided to impose a fine on Televisa for 53 million 838 thousand pesos. 
This penalty stems from a lawsuit brought by the former Federal Competition Commission (CFC), which ruled that the IFT missed the agreed arrangements when he was allowed to buy Television International (TVI). 
According to a decision of the Full Federal Telecommunications Institute (IFT) on August 15, Antitrust Unit (ECU) regulator may even dissolve the purchase authorized by the regulator in the field above. 

"Failure to comply with the condition in subsection D of paragraph three of the resolution in a period not exceeding 30 calendar days, the IFT have not fulfilled the conditions of the authorization and leave no effect concentration" the document states. 

The regulator decided -4 to 3 votes-that Corporate Vasco de Quiroga (CVQ), a subsidiary of Televisa, did not comply with the third paragraph of the resolution of the CFC then now Cofece, which provided that, as a condition of no affect competition in telecommunications, could not be members of the board of directors in other companies or restricted television audio. 
The company failed because, before making another concentration -autorizada Iusacell in 2012 by the former CFC had executives in that company. 
Analysts welcomed the decision but warned of the challenges ahead. 
"I think the IFT, as telecom competition authority should consider that (onwards) when it imposes commitments to approve a merger or acquisition, have a specific area that is dedicated to monitoring and assessing compliance with them to identify promptly any missing, "said Víctor Pavón-Villamayor, competition expert. 
Meanwhile, also on August 15, the IFT decided unanimously in general, not monopolistic practices were committed in the TV advertising market and the selling of content by Grupo Televisa (GTV). 
Telmex and MVS-for Dish- claimed that the company had refused to sell advertising space, plus they had given different conditions for their subsidiaries to sell content on broadcast television, among other practices, to displace the market. 
According to the IFT there were elements that led to the conclusion that the conduct of GTV and Televisa, had the object or effect of unduly displace other operators in the pay TV market.
